Wizcart Privacy Policy

Welcome to Wizcart ("we," "us," "our"). Your privacy is a cornerstone of our business. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our website, mobile application, and any related services (collectively, the "Platform").

This policy is designed to be transparent and compliant with key data protection laws in the jurisdictions where we operate, including:

  • United States: The California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), and the Children's Online Privacy Protection Act (COPPA).
  • Canada: The Personal Information Protection and Electronic Documents Act (PIPEDA) and Quebec's Act to modernize legislative provisions as regards the protection of personal information (Law 25).
  • India: The Digital Personal Data Protection Act, 2023 (DPDP Act).

We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household ("Personal Information").

  • Payment Information: Credit/debit card details, billing address, and transaction history. (Note: Full payment details are processed by our secure third-party payment processors).
  • Service Request Details: Information about the services you request, including location, time, and specific requirements.
  • Commercial Information: Records of services purchased, obtained, or considered.
  • User-Generated Content: Reviews, ratings, and feedback you provide about Service Providers.

2.2. Information Collected from Service Providers

  • Identifiers: Name, business name, contact information (email, phone number), and physical address.
  • Professional and Employment-Related Information: Service offerings, qualifications, certifications, licenses, and, where applicable, information about your employees who will perform services.
  • Financial Information: Bank account details for processing payments and commissions.
  • Sensitive Personal Information: Where required for safety and trust, we may collect government-issued identification and information for background checks, in compliance with applicable laws. This is done with your explicit consent.
  • Commercial Information: Records of services provided and transaction history.

2.3. Information Collected Automatically from All Users

  • Internet or Other Electronic Network Activity Information: IP address, browser type, device identifiers, operating system, pages viewed on our Platform, and timestamps of your visits.
  • Cookies and Tracking Data: We use cookies and similar tracking technologies to track activity on our Platform and hold certain information. See Section 7 for more details.

2.4. Methods of Data Collection

  • Directly from You: When you register an account, submit a service request, or communicate with us.
  • Automatically: Through cookies and other tracking technologies when you interact with our Platform.
  • From Third Parties: We may receive information from third-party services, such as payment processors or background check providers, to supplement the information we collect.

3. How We Use Your Information

Our use of your Personal Information is limited to the purposes disclosed to you, in adherence with the "purpose limitation" principle under PIPEDA (Principle 4.2) and the DPDP Act (Section 4).

  • To Provide and Manage Services:
  • Facilitating the booking, scheduling, and fulfillment of services between Customers and Service Providers.
  • Processing payments, commissions, and other financial transactions.
  • Creating and managing user accounts.
  • For Communication:
  • Sending transactional communications (e.g., booking confirmations, reminders).
  • Responding to your inquiries and providing customer support.
  • Sending marketing and promotional communications, from which you can opt-out at any time, in compliance with Canada's Anti-Spam Legislation (CASL) and other applicable laws.
  • For Platform Improvement:
  • Analyzing usage trends to improve the user experience and develop new features.
  • Personalizing your experience by showing relevant service listings and content.
  • For Safety, Security, and Compliance:
  • Verifying user identities and conducting background checks (where applicable and with consent).
  • Preventing fraud, spam, abuse, and other harmful activities.
  • Complying with our legal obligations, as required by law enforcement or regulatory bodies. This aligns with our obligations under CCPA/CPRA (Cal. Civ. Code § 1798.100) and the DPDP Act (Section 7).
  • Resolving disputes between users or with Wizcart.

4. Data Sharing and Disclosure

We only share your Personal Information in the following circumstances:

  • Between Customers and Service Providers: We share necessary information (e.g., name, contact details, service location) to facilitate the requested service.
  • With Third-Party Service Providers: We engage trusted third parties to perform functions on our behalf, such as:
  • Payment Processors: To securely handle financial transactions.
  • Analytics Providers: To help us understand Platform usage.
  • Background Check Providers: For Service Providers who opt into our verification programs.
    These providers are contractually bound to protect your data and use it only for the purposes we specify, a requirement under PIPEDA (Principle 4.1.3) and the DPDP Act (Section 8).
  • For Legal Reasons: We may disclose your information if required by law, subpoena, or other legal process, or if we have a good faith belief that disclosure is necessary to protect the safety of our users, prevent illegal activity, or defend our legal rights.
  • In Business Transfers: If Wizcart is involved in a merger, acquisition, or asset sale, your Personal Information may be transferred. We will provide notice before your information is transferred and becomes subject to a different privacy policy.

5. Data Security

We implement and maintain reasonable administrative, technical, and physical security measures to protect your Personal Information from unauthorized access, use, alteration, or destruction. These measures are designed to meet the standards set forth in CCPA/CPRA (Cal. Civ. Code § 1798.150), PIPEDA (Principle 4.7), and the DPDP Act (Section 8). While we strive to use commercially acceptable means to protect your data, no method of transmission over the Internet is 100% secure.

6. User Rights Regarding Personal Information

You have specific rights concerning your Personal Information, which vary by jurisdiction. We are committed to facilitating the exercise of these rights.

6.1. For All Users

  • Right to Access: You can request access to the Personal Information we hold about you.
  • Right to Rectification: You can request that we correct or update any inaccurate or incomplete data.

6.2. For Residents of the USA (California)

Under the CCPA/CPRA, you have the following rights:

  • Right to Know: To request disclosure of the specific pieces and categories of personal information we have collected, the sources of that information, the business purposes for collecting it, and the categories of third parties with whom it has been shared.
  • Right to Delete: To request the deletion of your personal information, subject to certain exceptions.
  • Right to Correct: To request the correction of inaccurate personal information.
  • Right to Opt-Out of Sale/Sharing: To direct us not to "sell" or "share" your personal information for cross-context behavioral advertising.
  • Right to Limit Use of Sensitive Personal Information: To limit our use of your sensitive personal information to that which is necessary to perform the services.
  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

6.3. For Residents of Canada

Under PIPEDA and Quebec's Law 25, you have the right to:

  • Access and Correct Your Information: As outlined in PIPEDA Principle 4.9.
  • Withdraw Consent: You may withdraw your consent to our collection, use, or disclosure of your information at any time, subject to legal or contractual restrictions.
  • Data Portability (Quebec): The right to receive your computerized personal information in a structured, commonly used technological format.

6.4. For Residents of India

Under the DPDP Act, 2023, you have the right to:

  • Access Information: To obtain a summary of the personal data being processed and the processing activities undertaken (Section 11).
  • Correction and Erasure: To correct inaccurate data and erase data that is no longer necessary for the purpose it was collected for (Section 12).
  • Grievance Redressal: To have a readily available means of addressing grievances with us (Section 13).
  • Nominate: To nominate another individual to exercise your rights on your behalf in the event of your death or incapacity (Section 14).

7. Cookies and Tracking Technologies

We use cookies and similar technologies to enhance your experience, analyze platform performance, and for marketing. You can control the use of cookies at the individual browser level. For non-essential cookies, we will obtain your explicit, opt-in consent, in line with requirements in Canada and India. For California residents, we recognize opt-out preference signals like the Global Privacy Control (GPC).

8. International Data Transfers

Your information may be transferred to — and maintained on — computers located outside of your state, province, or country where the data protection laws may differ.

  • For Canadian Residents: Before transferring personal information outside of Canada (and specifically Quebec), we will ensure it receives a comparable level of protection through contractual safeguards. For transfers outside Quebec, we will conduct a Privacy Impact Assessment (PIA) as required by Law 25.
  • For Indian Residents: We will only transfer personal data outside of India in accordance with the provisions of the DPDP Act (Section 16), which allows transfers to any country unless specifically restricted by the Central Government.

9. Children's Privacy

Our Platform is not intended for use by anyone under the age of 18. We do not knowingly collect Personal Information from children. This policy is designed to comply with COPPA in the USA and the specific duties towards children outlined in the DPDP Act (Section 9) in India, which prohibits processing that is likely to cause harm to a child. If we become aware that we have collected data from a child without verification of parental consent, we will take steps to remove that information.

10. Policy Updates

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new policy on this page and updating the "Effective Date" at the top. For material changes, we will provide a more prominent notice (such as an email notification).
